1. Introduction

Welcome to yumyard.shop (“we”, “us”, “our”). By accessing or using https://yumyard.shop (“the Website” or “the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with these Terms, please do not use the Website.

These Terms apply to all users of the Website, including visitors, registered users, and purchasers of our digital products.

2. Description of the Service

We provide access to digital recipes, meal plans, and other culinary-related digital content through a credit-based system (“Credits”). Users may purchase Credits and exchange them for access to digital content (such as recipes and meal plans) available on the Website.

Our platform is powered by a custom “Kitchen Plugin,” which manages user access, point balances, and content delivery.

All payments are processed by Paddle.com (“Paddle”), which acts as the Merchant of Record.

3. Merchant of Record / Payments

All purchases made on yumyard.shop are securely processed by Paddle, acting as Merchant of Record. Paddle handles payment processing, applicable VAT/sales tax, and invoicing.

This means:

Paddle is the entity that appears on your bank or card statement.
Paddle handles VAT, sales tax, MOSS/OSS compliance, and tax reporting where required.
You will receive purchase receipts directly from Paddle.

Your payment details (such as credit card numbers) are processed by Paddle and are not stored on our servers.

4. User Accounts

To purchase Credits and access digital content, you may need to create an account on yumyard.shop.

You agree to:

Provide accurate and up-to-date information during registration.
Keep your login credentials confidential and secure.
Be responsible for all activities that occur under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or are involved in fraudulent or abusive activities.

5. Digital Credits (Points)

Our platform uses Credits (points) as a virtual currency for accessing digital content.

Credits can be purchased via Paddle and are added to your account after a successful payment.
Credits can only be used on yumyard.shop and have no cash value.
Credits are non-transferable and cannot be exchanged for money or used outside of yumyard.shop.
We may, at our discretion, offer free Credits as part of promotional or trial offers.

If applicable, Credits may expire after a certain period. Where expiration applies, this will be clearly indicated in the relevant offer or package description.

6. Digital Products and License

All recipes, meal plans, and related materials available through the Website are digital products.

When you redeem Credits for content, you receive a personal, non-exclusive, non-transferable license to access and use that content for your own private, non-commercial use.

You may not:

Resell, redistribute, or publicly share the content.
Use the content for commercial purposes without our prior written consent.
Remove or alter any copyright or proprietary notices.

7. Intellectual Property

All content on yumyard.shop, including but not limited to text, images, graphics, logos, icons, and software, is the property of ESTA RP Uroš Nešić or its licensors and is protected by applicable intellectual property laws.

Nothing in these Terms grants you any rights to our trademarks, logos, or other proprietary materials except for the limited license to use the Service for personal purposes as described above.

8. Refunds

Because our products are digital and delivered instantly, refunds are limited. Our detailed Refund Policy is available on a separate page and is incorporated into these Terms by reference.

Refunds, where applicable, may be processed by Paddle and are subject to both our Refund Policy and Paddle’s own policies and applicable consumer protection laws.

9. Prohibited Use

You agree not to use the Service for any unlawful or prohibited purpose, including but not limited to:

Attempting to bypass payment or access controls.
Sharing your account with others or reselling access.
Distributing or publishing our digital content without permission.
Uploading or transmitting malicious code or attempting to compromise the security of the Website.

10. Termination

We may suspend or terminate your access to the Service, with or without notice, if we reasonably believe that you have violated these Terms, abused the refund system, or engaged in fraudulent or illegal activity.

You may request deletion of your account at any time by contacting us at admin@yumyard.shop.

11. Disclaimer of Warranties

The Service and all digital products are provided “as is” and “as available,” without warranties of any kind, either express or implied. We do not guarantee that the content will meet your expectations, or that access to the Service will be uninterrupted or error-free.

12. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service or digital products.

Our total liability for any claim arising out of or relating to these Terms or the Service shall be limited to the total amount you paid for Credits in the three (3) months preceding the event giving rise to the claim.

13. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Serbia, without regard to its conflict of law rules.
